Obstacles and resistance to the process of implementingthe right to free, prior and informed consultation and consent in Brazil

The right to free, prior and informed consultation and consent, as established under the framework of
Convention 169 of the International Labour Organization, the United Nations Declaration on the Rights of Indigenous Peoples, and national and international jurisprudence(Inter-American Human Rights System and the UN system),faces serious challenges in terms of its full recognition and implementation in Brazil.
